The General Terms and Conditions determine the relationship between the buyer and the seller and apply to all purchases made through the online store or by phone. All of the provisions are binding and valid until revoked or amended.

By placing an order, you confirm that you are familiar with the full text of the General Terms and Conditions set out here and that you fully agree with them.

AVAILABILITY OF INFORMATION

The provider undertakes to always provide the buyer with the following information:

1. a) company identity (name and registered office of the company, register number);
   b) contact details enabling the user to communicate quickly and efficiently (e-mail, telephone);
   c) the essential characteristics of the goods or services (including after-sales service and guarantees);
   d) availability of the products (any product or service offered on the website should be accessible within a reasonable time);
   e) conditions of delivery of the product or execution of the service (method, place and time of delivery);
   f) all prices must be set clearly and unambiguously and it must be clearly indicated whether they already include taxes and shipping costs;
   g) payment and delivery method;
   h) time validity of the offer;
   i) the period within which it is possible to withdraw from the contract and the conditions for withdrawal; in addition, whether the customer incurs any costs when returning the product and, if so, how much;
   j) an explanation of the complaint procedure, including all details of the relevant contact person or customer service department.

PAYMENT METHODS

The provider accepts the following payment methods:

• personal collection at the company headquarters;
• cash upon receipt of the package, paid to the postman of Post of Slovenia;
• proforma invoice transfer to the Koala Sport d.o.o. bank account;
• Paypal to the company’s account,
• payment or credit card (Mastercard, Visa, BA Maestro, American Express).

PACKAGING AND DELIVERY

The cost of packaging and delivery of one package to an address in Slovenia amounts to €4.89, except for products where the cost of delivery is specifically stated. For orders with a total value over €150.00, the delivery costs are covered by the provider.

Note: these terms and conditions as well as the cost of packaging and delivery are valid only within the Republic of Slovenia.

DELIVERY TIME

All orders placed before 1.00 pm on a working day will be shipped the same day in the case of payment on delivery, via Paypal or by payment card. Orders marked payment by proforma invoice are shipped as soon as the bank transfer is received. Orders placed during weekends and holidays will be shipped immediately on the next business day. In the case of products with a specifically marked longer delivery time, that delivery time is taken into account.

PRODUCT OFFER AND PRICES

Due to the nature of online business, the offer and prices in the Koala Sport online store are frequently updated and changed. The price in the Koala Sport online store is the same for both online store registered members and guests. All prices include VAT. Prices are valid at the time of placing the order and do not have a predetermined validity.

PROMOTIONAL CODES

A discount code brings various purchasing benefits and is time-limited. You can find the active discount code in our e-newsletters or other media. Discount codes CANNOT be combined, unless stated otherwise.

THE CONSUMER’S RIGHT TO WITHDRAW FROM THE CONTRACT

In the case of distance contracts, the consumer has the right to notify the company of their intention to withdraw from the contract by e-mail (koalasport@siol.net) or via some other communication channel within 14 days, without having to state a reason for their decision.

The consumer must return the goods to the company no later than 14 days after notification of withdrawal from the order. The consumer returns the goods to the address: Koala Sport d.o.o., Bevkova ulica 34, 4240 Radovljica, Slovenia.

The only cost borne by the consumer in the case of withdrawal from the order is the direct cost of returning the goods.

The consumer must return the item to the seller undamaged and in the same quantity, unless the item has been destroyed, damaged, lost or its quantity has decreased at no fault of the consumer.

When returning goods, the consumer must also send the invoice for the goods, personal data and the number of the transaction account on which they wish to receive the refund. The refund will be made within 14 days of receipt of notice of withdrawal from the contract.

Upon withdrawal from a contract in which a promotional or discount code was used, these funds are considered as a discount and are not returned to the user. Only the paid amount is returned to the user’s bank account, while the promotional code is returned to the user in the form of a new code. Upon withdrawal from the contract, a gift voucher is considered as a means of payment and returned to the user as a gift voucher.
 
THE RIGHT TO WITHDRAW FROM THE EXECUTION OF THE CONTRACT

We reserve the right to exceptionally (partially) withdraw from the execution of an order in the case that: the ordered products are not in stock, an increased payment risk of the buyer is identified, the order was not completed in accordance with the General Terms and Conditions, or there was an obvious error in the price list. In all such and similar cases, we will immediately notify you by e-mail of any withdrawal from the contract.

LIABILITY FOR ACTUAL ERRORS

The seller is liable for material defects of the product at the time when the risk passed to the buyer, regardless of whether the defect was known or not. The seller is also liable for material defects that appear after the risk has passed to the buyer if they are due to a pre-existing cause. Minor material defects are disregarded.

COMMUNICATION

The provider will contact the user via distance communication means only if the user does not explicitly object. Electronic and/or text advertising messages will contain the following components: – they will be clearly and unambiguously marked as advertising messages;
– the sender will be clearly identified;
– various campaigns, promotions and other marketing techniques will be marked as such.
The conditions for participation in such communication will also be clearly defined:
– the method of unsubscribing from receiving advertising messages will be clearly presented;
– the provider will explicitly respect the user’s wish not to receive advertising messages.

LEGAL NOTICE

The KOALA SPORT online store and all of the data, product images, graphic and video elements on the website are protected by the Copyright Act and may not be reproduced or used without prior written permission.

COMPLAINTS AND DISPUTES

Koala Sport d.o.o. respects applicable consumer protection legislation. Koala Sport d.o.o. endeavours to the best of its ability to fulfil its duty to establish an effective complaint handling system. Complaints are submitted via e-mail to ikoalasport@siol.net or in writing to Koala Sport d.o.o. The complaint handling procedure is confidential. Koala Sport d.o.o. endeavours to the best of its ability to resolve any disputes amicably or by an out-of-court settlement; in the case that this is not possible, disputes will be resolved by the court with substantive jurisdiction.

OUT-OF-COURT SETTLEMENT OF CONSUMER DISPUTES

In accordance with the legislation arising from the Out-of-Court Settlement of Consumer Disputes Act, Regulation (EU) No 524/2013 of the European Parliament and of the Council on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC, Koala Sport d.o.o. does not recognise any provider of out-of-court settlement of consumer disputes as competent for resolving consumer disputes that could be initiated by the consumer in accordance with the Out-of-Court Settlement of Consumer Disputes Act.
